The Johns Creek City Council voted Feb. 24 to accept the withdrawal of rezoning case RZ24‑0011 (3730 Old Alabama Road) after staff said the property's purchase contract was terminated.
"The applicant is the proposed purchaser of the property... I believe from what we've been told that the property owner has terminated the contract," Director Song told the council. City staff and council discussed that acceptance of the withdrawal "will result in the property not being able to go through another rezoning for a period of 12 months." The council approved the withdrawal by motion and voice vote.
Council members asked whether proceeding with the hearing would have been valid given the contract status; staff confirmed the hearing would be invalid if the contract were not in effect. No further action on the property was taken at the meeting; the withdrawal effectively pauses zoning applications for that parcel for a year.
