Summary

The Planning & Zoning Board recommended approval of VA2414 on Aug. 14 to allow a swimming pool within the mean high-water setback at 166 East Corey Drive, with the applicant confirming that no screened enclosure will be installed.
Staff presented the application and noted past variances for in-ground pools in the neighborhood and that, under Article 9, section 21-100.04(d), the applicant had not met all six criteria the staff typically applies. The property is about 0.95 acres and the applicant sought a 20-foot setback from the mean high-water line in lieu of the 50-foot requirement.
Applicant Laurie Adams said the property owner is not adding a screen enclosure. Pool contractor Nils Erickson, who said he has worked on several similar projects, told the board he had installed pools closer than the standard setback in other nearby properties and that the board has received similar requests before. "I've probably pulled (permits) 4 or 5 times for the same reason," Erickson said.
A board motion to recommend approval included a note explicitly that the screen room would not be added; the motion passed on roll call.
Provenance: topic introduced SEG 399; public hearing and motion concluded SEG 539.
