The Herndon Town Council approved Ordinance 26‑018 on July 28 to authorize an encroachment agreement permitting AM Worldgate Owner LLC to allow potential increased stormwater ponding and overland relief on a portion of town-owned Shandon Park tied to the redevelopment of the adjacent Worldgate property. Deputy Town Attorney Lori Sigler said the yellow-outlined area totals about 25,621 square feet with an incremental increase of roughly 14,930 square feet that would be allowed to experience additional temporary ponding under certain conditions.
Sigler explained that the applicant agreed to pay approximately 25% of the square-foot value for the incremental area — “for a total of $16,012” — and must restore or repair park improvements damaged by any encroachment and maintain insurance for the town’s benefit. Supervisory engineer Jonathan Franzel described the drainage: the swale slopes to a central point where depth can reach about 4.5 feet during a 100-year event; staff said some temporary backup occurs even without the new development but the agreement formalizes permission and mitigation obligations.
Matt Bonifin, representing AM Worldgate, added that the retaining wall and grade changes are intended in part to enable a trail extension connecting Eldon Street to Shandon Park as part of the site plan. Council moved and passed the ordinance by roll call 6–0 with one member absent.
