The Stephens County Planning Commission approved a rezoning that transfers 0.066 acres from agricultural-residential to residential single for a parcel owned by James Bruce III, a change staff said would allow the southern neighbor full access to an area they have been using.
Maurice Daley, the adjoining property owner at 88 Buena Vista Drive, told the commission that his father built a driveway and carport in 1987 and that the small parcel conveyance would formalize long-standing use: “Apparently, back in 1987, my father built a driveway and a carport into the home and he used a property line that was a well established, to his knowledge, was well established.” Daley asked the commission to approve the rezoning so the driveway and utility building would belong to the buyers of the neighboring property.
Staff had recommended approval and the commission moved, seconded and approved the rezoning by voice vote. The staff noted the item advertised 0.066 acres and that plat approval would be a separate process if the owner pursues subdivision in the future.
