Board denies request to change business name to 'Pipe Dreams Plumbing' citing likely public confusion

Legal counsel told the board that an applicant seeking to change its name to "Pipe Dreams Plumbing" would likely cause public confusion because an existing licensee holds that same or nearly identical name in East Tennessee. "TCA 62 dash 6Dash111, subsection m says the board shall deny an applicant if the board determines the name is identical or so nearly similar to an already existing licensee that it is likely to cause confusion to the public," counsel said.
Board members agreed with the legal recommendation and voted to deny the name-change application (file 84970). Counsel noted that denial is appropriate where names are identical or highly similar and the licensees may operate in overlapping areas; the board did not take further action beyond denial and instructed staff to notify the applicant.
