Development Services Director Nicole Dritz described the requests: relief to allow a 0‑foot rear setback (versus 10 feet required) and 0‑foot corner lot side setback (versus 15 feet required) for a dumpster location (VAR‑24‑005) and an exception to allow a 6×8 dumpster enclosure where code requires 8×10 (VAR‑24‑006). Dritz reported the Planning Commission reviewed the matter on Aug. 28 and recommended denial and that staff had proposed alternatives including curbside collection and relocating the enclosure within property lines.
Applicant Sandra Tallon described operational constraints at her multi‑unit property on a dead‑end narrow street and argued that side‑loader trucks would gouge swales and block driveways; she urged the council to allow the on‑site dumpster and smaller enclosure. Tallon said, “The side loaders don't work. End of story.” Council members expressed concern about impacts to adjacent property owners, the nonconforming configuration of the site, and public‑safety/access problems. The motion to deny VAR‑24‑005 passed (recorded as Motion carries 4‑0‑1) and the motion to deny VAR‑24‑006 passed 4‑1. Staff will continue to work with the applicant on alternate collection arrangements and potential site adjustments.
