The Kane County Planning and Zoning Commission voted to recommend allowing the land‑use administrator to process amendments and to remove temporary compliance holds for the Camp Kya conditional‑use permit after verification that required permits are obtained.
"This is an administrative item, for Camp Kya. It is going to be a discussion and possible action regarding administrative updates to the conditional use permit, including considerations of authorizing the land use administrator to process amendments and to remove the temporary compliance holds upon verification that all required permits have been obtained," staff member Shannon said during the item introduction. Shannon told commissioners the change would let the project continue work in areas that do not require Corps permits while the Army Corps of Engineers considers wetlands and a bridge crossing.
Commissioners pressed staff on liability and timing. A staff/agent explained that after the Army Corps reviewed the site they concluded the wetland area is jurisdictional and that "instead of not having to have a permit from the state, now we have to have a permit from the corps." Staff said the Corps had indicated the applicant could use portions of the site for construction but could not make improvements in the Corps‑jurisdictional areas until permits were issued.
Mister Chair, I move that we recommend approval, a commissioner said; the motion was seconded and carried. The body recommended the administrative change; the final decision will be made by the County Commission. The recommendation directs the land‑use administrator to process CUP amendments and remove temporary compliance holds only after required permits have been verified.
