The applicant’s representative said the changes were largely architectural and de minimis from the street and would support a higher‑end residential design. As the applicant’s counsel put it, the height change was “3% of the size of the overall size of the building and essentially invisible from the public.” Planning staff noted some variance criteria were not satisfied and therefore did not recommend approval, while the Planning and Zoning Board recommended approval. The commission voted 4–1 in favor of the variances; the mayor cast the sole no vote, stating a concern about granting a variance on a hardship basis when the developer’s choices produced the condition.
The vote allows the applicant to proceed with final design steps subject to any conditions imposed as part of the approval.
