The Board of County Commissioners approved a rezoning request to change a roughly 5-acre property from Rural Residential to Limited Commercial to allow a landscaping business and a residence, subject to a protective overlay restricting uses to construction sales and services and retaining residential sign standards.
Scott Whitehall of the Planning Department summarized the application and the review history, noting MAPC's 12-0 recommendation and a protest period that came in under the state's 20% threshold. Applicant Matt King told the board he planned to run Johnson's Legacy Landscapes from the property and offered to accept restrictions: "Absolutely not [I object to a restriction to landscaping business]... this is my future home. It's where I wanna be for the next, you know, 25 years. So I have no problem with that," he told commissioners.
Nearby residents who spoke during the public hearing raised concerns about drainage, gravel-road traffic and the loss of a residential buffer next to an M1 industrial district. Commissioners debated three options (plain LC zoning, protective overlay, or rezoning a portion of the parcel) and settled on a protective overlay that allows rural-residential rights plus construction sales and services as a defined means to authorize landscape business operations while limiting other retail or medical uses. The motion to approve the zone change with protective overlay passed on a roll-call vote.
