Business association asks Red Lion planning commission to delay enforcement of transient retail ordinance

Ian Montgomery, representing the RL Business Association, asked the Red Lion Borough Planning Commission on March 17 to request that Borough Council delay enforcement of the borough's transient retail merchants ordinance "until it is finalized by the solicitor and approved by the council." Montgomery said the ordinance "has not been enforced in the past" and that the community should be given notice through advertisement before enforcement begins.
Commission member Cindy Barley and Borough Manager Michelle Poole said the merchant fee helps reimburse public works for the hours required to support sanctioned events such as the street fair. Member Evan Hiester added that "there are rules and regulations we have to enforce during these events," which he said generates additional costs to the borough. Sam Craley, a visitor who spoke during public comment, said Dallastown Borough enforces its merchant fee, noting enforcement practices differ among neighboring jurisdictions.
The commission did not take formal action at the March meeting because the agenda had not been posted on the internet 24 hours in advance. Attorney Mike Craley provided a draft of Ordinance No. 2025 for review; the Planning Commission will consider a recommendation in April, with the earliest Council review scheduled for a May work session and a potential June Council meeting appearance.
