The Overland Park Planning Commission voted 11–0 to recommend approval of a special‑use permit (SUP2026‑00008) for Family Tree Nursery, allowing a proposed 125,000‑square‑foot landscape nursery at the southwest corner of 167th Street and U.S. 69.
Planning staff described the conceptual site plan, including customer pickup circulation, employee parking, new street trees along 167th, and a proposed 30‑foot greenway linkage easement. Staff recommended approval for an indefinite period and highlighted a small wording change in stipulation H: "the surety shall be released once the right of way has been vacated and a certificate of compliance is issued for the removal of the entrance," staff noted during the presentation.
Kurt Peterson, representing Family Tree Nursery, told commissioners he and the owners were pleased with staff's report and stipulations. "I've had, since moving back to Kansas City 18 years ago, an absolute crush on Family Tree," Peterson said, adding the company supported stipulations A through V with the adjusted language.
Neighboring landowners raised questions about future cross‑property access. Aaron March, representing the Price family to the west, said staff's blanket access easement along the shared property line needed clarification and asked that the commission avoid imposing an inflexible standard requiring access at unspecified future points. "We're solving a problem that doesn't exist," March said, urging more precise language about where future access would connect to the public 168th Street.
Commissioners asked staff to explain why an indefinite permit term was recommended; staff said the project's capital investment and a prior indefinite SUP on the site supported the indefinite term. Following discussion, Commissioner Sorensen moved approval of SUP2026‑00008 with the revised stipulation H and stipulations A–V. The motion carried 11–0. City council will consider the request at its June 1 meeting at 7:30 p.m. in the same chamber.
