The board considered a use-variance request from Apex Trailer (represented by Corey Warden and Chris Long) to establish a semi/trailer parking lot at Cutter Drive and Progress Way but delayed and ultimately accepted a withdrawal after questions about whether the lot would be used as a showroom or for occasional sales.
Planning staff told the board the Veterans Parkway Corridor Zone does not permit parking as a principal use and that, while the proposed lot (parcel ID 10140330178000011) could be used for parking only, any sale-of-vehicles activity would constitute a different use requiring separate notice and a separate variance. Staff noted the application, as advertised, requested relief for parking only and did not put the public on notice for vehicle sales.
Applicant Corey Warden described the proposal as a showroom and storage area tied to nearby repair and sales operations; "it would strictly be a showroom lot to with bridal, shiny new equipment," he said. Board members pressed on how the business would operate and whether customers would visit the lot to complete sales. Several members said acting on a sales use that was not noticed could be vulnerable to appeal.
After staff explained the legal concern, the applicants asked to withdraw the current application and indicated they would refile with clear notice if they intend to include sales. The board voted to accept the withdrawal rather than deny the parking variance on the record.
Staff reminded applicants that any future filing that adds sales as an intended use must be publicly noticed and would require additional review and possibly additional variances.
