Council approves $4.14 million award for Theater Ditch flood-mitigation project

City staff recommended awarding the contract to Veil Enterprises LLC. As staff stated during the presentation: "Staff recommends bid number 2020B be awarded to Veil Enterprises LLC who submitted a bid in the amount of $4,140,000 for a term of 365 calendar days and waive informality in the bidding." Staff said six bids were received, one proposal contained a $1,000 mathematical error that did not change the low-bid status, and the work is included in the FY2024 capital improvement plan and funded by CDBG‑MIT grant funds.
Council members pressed staff on construction impacts and schedule. Council Member Hector asked whether work would affect traffic on Avenue Inn and whether the contract term was a full 365 days; staff confirmed the schedule and said crossings and some adjacent streets would be reconstructed after the work. Council Member Felix asked whether the city had considered a bidder that proposed an eight‑month completion at a higher price; staff replied that because the project is funded by federal CDBG‑MIT grant funds, procurement rules require awarding to the lowest responsible bidder and explained that "we have to go in that direction because of the grant funds."
Mayor Ray asked staff to ensure neighbors receive advance notice; staff said door‑hanger notifications and preconstruction outreach will be used in affected areas. After discussion, Council Member Hector moved to approve Resolution R3952; Felix seconded and the mayor called the vote. The mayor announced the vote in favor and declared the motion carried.
The project scope described by staff includes concrete lining of the ditch from north of Avenue toward the airport and other channel and crossing work intended to reduce local flooding in the theater ditch watershed. The council did not change the award recommendation; any further project-level questions will be addressed in a follow-up meeting, per the mayor’s remarks.
