Notus City Council on May 19 approved a motion authorizing Mayor David Porterfield and the city attorney to assemble and execute a purchase contract to acquire 246 Fargo Ave. for $269,000, subject to due diligence and clear title.
Councilman Rob Hartsock moved that "the Mayor be approved to put the contract together with our attorney to purchase 246 Fargo Ave., with the due diligence of no less than 30 days, to include clear title and purchase out right, with the right legal property description for $269,000.00." The motion was amended to allow the mayor and attorney to take additional legal steps needed to effectuate the purchase. Roll call: Hartsock yes; Ahlborn yes; Conner no. The motion carried.
Council did not finalize closing or funding details during the meeting; staff and the attorney will return with the contract and any necessary title documentation for the mayor to execute. The authorized due-diligence period is a minimum of 30 days to confirm title and legal description.
