City Attorney Ben Layman reviewed the Findings of Fact and Conclusions of Law related to the Triple Dot Development and the accompanying Development Agreement. Councilmember Devin Krasowski said he would vote no because, he argued, “the findings do not accurately reflect the record,” and Councilwoman Lupita Connor said a petition had been submitted and “this was really pushed through and we really ignored the public.” Layman characterized the drafted findings as procedural, saying the document was “just a formality” because annexation and rezoning had already been approved.
Councilmember Steve Ahlborn moved to approve the findings and Development Agreement with the attorney’s corrections; Rob Hartsock seconded. The roll call showed Ahlborn and Hartsock in favor and Krasowski and Connor opposed; Mayor Porterfield cast the deciding yes vote and the motion carried.
During ordinance consideration the council voted to dispense with the three‑day reading rule and read Ordinance #483 by title. Ahlborn moved to adopt Ordinance #483, Hartsock seconded, and Ahlborn amended the motion to include “the attorney changes noted above.” The roll call again left the council split; Mayor Porterfield voted yes to adopt the ordinance.
The development record as described in council discussion requires the developer to submit a phasing plan with building permit applications, and permits will be denied when sewer capacity is reached. The developer has requested access from Purple Sage Road and the plan includes installing a water sampling station.
The decisions conclude the council’s formal approvals for the Conway Ridge annexation and related development documents; opponents on the council said the recorded findings do not reflect public concerns and a signed petition.
