During the Feb. 4 Design Review Board meeting, city staff presented the specific variance and waiver requests attached to Regent Partners’ application for four parcels on Hardy Avenue and 4th Street. Staff said the applicant had requested six variances and seven waivers affecting façade placement, materials and streetscape standards.
Staff listed the major variance and waiver items presented: allow a bronze rather than silver national green building standard; permit ground‑floor multifamily uses within 100 feet of Hardy Avenue on the public alley; reduce the minimum 60% balcony requirement to 0%; reduce required exterior brick/stone from 60% to 30%; allow off‑street parking between the principal building and 4th Street; allow lap/fiber‑cement siding and wood framing for a building over three stories; and reduce required landscape/sidewalk widths along 4th Street (staff cited a requested reduction from 10 feet to 8.8 feet). "The applicant would be requesting, 6 variances and 7 waivers," staff said.
The board discussed how some waivers interact with open‑space calculations and retaining‑wall constraints. The applicant indicated they would review the landscape strip and sidewalk details with staff and consider design adjustments to reduce the need for variances where feasible.
