Council considered multiple variance and waiver requests for a project at 3535 Ashton Woods Drive. The motion approved some waiver requests but denied two variance requests and attached four conditions: (1) a written invasive removal plan prepared by a qualified land restoration firm; (2) an engineered plan to restore downslope erosion caused by a curb cut; (3) a plant‑rescue allowance for native species by the Georgia Native Plant Society or Keep Chamblee Beautiful with at least two months' notice; and (4) voiding a prior council action (PZ2025-1538) dated Nov. 18, 2025.
Planning staff told the council there is no longer a triggering activity in the December 15 stamped site plan that would require an open‑space reduction variance. The applicant’s representative said the request "remains to have, that number 1 approved" to avoid returning if staff interpretation changes; the council discussed recording in the minutes that the denial was based on the variance not being necessary for the site plan. The motion as stated by council member Vythe was recorded as approved (in part/denied in part) in the minutes.
