Planning staff said the clinic at 3645 Chamblee Dunwoody Road occupies a 0.45-acre corner lot and cannot construct a compliant rear-yard enclosure due to steep topography behind the site. "Because of the site's slope and building placement, the applicant is unable to construct a compliant closure in the rear yard," Matt Adams said, and staff recommended approval with two conditions, including conformity to the plan received 09/08/2025 and that the enclosure be constructed of brick or masonry similar to the primary structure.
Alice Price, speaking for the applicant, asked the council to allow a wooden enclosure in order to preserve flexibility for future aesthetic updates; she said the Jaeger family medicine practice has been in Chamblee for over 40 years and the dumpster has long been at the same location. Price said a wood structure would make it easier to match future exterior renovations.
Staff noted the request is tied to a 2024 code enforcement citation for an unenclosed dumpster and recommended conditions to address stability given the slope. The council did not vote on the variance during the work session; staff and applicants were told questions may arise again when the item returns for formal action.
