Avon BZA approves driveway variance to allow portion of driveway within storm sewer easement

The Avon Board of Zoning and Building Appeals on Feb. 4 approved a variance that permits a portion of a driveway and driveway pad at 3769 Blossom Lane to be installed within an existing storm sewer easement.
Matt Garland of Garland New Homes explained the request and said the variance was needed to maintain uniform driveway patterns in the subdivision while the easement runs between two lots. Garland said the homeowners will sign documentation acknowledging that if utility access to the easement is required, they will be responsible for any costs associated with removing and replacing the driveway.
Board members had no questions about the engineering or the homeowners’ acknowledgement and voted to un-table the matter before approving the variance. The vote on the approval was recorded as "AYES" all. The Chair declared the motion passed.
The variance request cited C.O.1248.19 (Improvements—Structures and Improvement within Utility Easement or Right-of-Way). Meeting minutes include an exhibit (site drawing and homeowner acknowledgement) documenting grading, base flood elevation notes and the homeowner acknowledgement language submitted with the request.
