Homeowner says city waterline work and staging caused sidewalk failures; inspectors disagree

Homeowner Joseph Marc Latina told the commission he believes the sidewalk and driveway defects cited in the city's Oct. 2025 inspection were caused by recent city-directed waterline construction and onsite staging, not by neglect. "The primary cause of the walk... was is by city directed construction activity," Latina said while presenting photos showing curb failure, low elevation at a curb inlet and apparent drainage collection.
City witnesses disputed that causal link. The housing inspector described a documented inspection timeline and exhibits and said only the concrete-related violation remained after multiple re-inspections. Streets Manager Thomas Bildstein testified he reviewed historical imagery showing similar cracks as early as 2008 and said he "didn't see any factors related to road work" that would indicate city projects caused the damage. The commission did not make a formal finding on causation but voted to uphold the violation and grant additional time for repair.
