He cited UDO section 5.11.5.e requiring a setback at least equal to tower height and said the lease on file covered only 13% of the fall radius, which he called insufficient for safe subdivision.
Calhoun urged the commission to redraw the subdivision so the entire 154‑foot fall radius sits inside a single parcel that will not receive commercial development and to require a recorded easement that controls the entire fall zone prior to any approval. Staff and applicants said the fall‑zone has been surveyed and that structures are not planned within the fall area; commissioners requested documentary evidence to resolve whether the current plat creates legal and safety conflicts.
