Planner flags unpermitted accessory dwelling at 101 Lakeview Road; board warned of double-fee penalty

The planning commission heard a conditional-use request for Rhonda Spearman to convert an existing permitted shop into an accessory dwelling at 101 Lakeview Road, a 5-acre parcel zoned RE-1. Planner materials showed interior work already completed, including finished wall coverings, prompting staff concern about inspections that could not be performed before finishing.
“Where we have a situation where activity has gone on that requires a permit and no permit was secured, you have the ability through your policies to double the permitting fee as a penalty for having failed to secure the permit,” a staff member told the commission. Staff noted the record should reflect when inspections were not performed and suggested noting that on the certificate of occupancy or the permit to shield the county from later claims.
Commissioners discussed whether to require the applicant to pay the difference between shop and dwelling fees and whether to require additional documentation or inspections now that the structure is closed behind drywall. The item was placed on the agenda for public hearing (scheduled for Aug. 3) so the board can consider conditions including any fee penalty and inspection plan.
If the board approves the conditional use, staff recommended recording conditions addressing inspections and disclosure to potential purchasers; staff also suggested including a time limit or remedial steps when permits are issued after work is complete.
