County manager cites proposed $78,300 IRS penalty for late W-2 filings; staff to investigate options

During the Manager's Report at the Oct. 23 Torrance County commission meeting, County Manager J. Jordan Barela reported that the IRS had proposed a penalty of $78,300 for W-2s that should have been filed by Jan. 31, 2023 but were filed late in 2023. Barela said staff found an IRS acknowledgment for the submission in August 2023 and are researching communications from the prior administration to determine whether grounds exist to grieve the penalty or negotiate a reduction.
Barela said the county has two principal options: accept and pay the proposed penalty or initiate a grievance/appeal process. He asked staff to continue investigating and to return to the board with a recommendation at the first meeting in November; he also said interest would begin to accrue if payment is not resolved after the Nov. 20 deadline. Commissioner Samuel Schropp suggested attempting to negotiate the amount down based on similar personal experience.
No formal board action was taken at the meeting; staff indicated they would pursue additional information and discuss next steps with the board.
