Commission corrects record, adopts findings on Tajique cell tower after appellate remand

A long-running dispute over a proposed telecommunications tower near Tajique returned to the County Commission after the New Mexico Court of Appeals asked the County to correct the zoning designation in the record. County Planning Director Don Goen and County Attorney Michael Garcia summarized the procedural history and the discrepancy: an earlier record had referenced Village Community Preservation (VCP) zoning for the parcel, but the parcel’s legal profile and GIS records show it lies in the Rural Community Preservation (RCP) zone.
Representatives for Gravity Pad Partners and for the Tajique Land Grant participated in the hearing. Gravity Pad counsel Jesse Hatch told the Commission the company had reviewed the revised findings and had no objection. "We endorse them as accurate, true, and appropriate," Hatch said of the corrected draft. The Commission adopted the corrected findings and conclusions, resolving the appellate remand and closing the procedural loop created by the prior record-keeping error.
