Charter commission defends appeals record as lawmakers press on facilities and oversight

Representatives of the Tennessee Public Charter School Commission appeared before the committee to discuss HB 1615, a sunset-extension bill. Executive Director Tess Stovall said the commission has received 40 new-start appeals since 2021, approving 16 and upholding 18 local decisions; she added six applications were withdrawn before a vote. "Since 2021, we've received a total of 40 new start appeals...16 of those have been approved and 18 of those decisions have been upheld," she said.
Lawmakers pushed on issues including which counties appeals came from, the commission's consideration of facilities and financial readiness, and whether the commission considers constitutional or federal law when assessing applications. Witnesses said the commission accepts public and written comment in local jurisdictions, evaluates applications against a state scoring rubric that includes academic, operational and financial metrics, and considers federal and state legal requirements. Committee members expressed concern about the cost of facilities and whether authorizations create fiscal strain for local districts; commission staff said facilities are a common challenge and that the commission evaluates facility plans as part of the application but cannot guarantee access to capital pre-opening.
After questions, the committee voted to advance the extension (7 ayes, 4 nays). Commission staff offered to follow up with county-specific financial estimates and other requested data.
