Neighbor asks Comal County to repair or reclaim 64-foot turnaround in 5 Oaks
Summary
Philip Rathbun, president of the 5 Oaks Property Owners Association, told commissioners the original 64-foot turnaround near 8865 5 Oak Circle was excluded from recent paving and asked whether the county intends to abandon the easement or repair it; he proposed removal and resurvey or full repaving and a site visit.

A neighborhood leader asked Comal County commissioners Aug. 15 to decide the fate of a 64-foot turnaround left out of recent repaving work in the 5 Oaks subdivision.
Philip Rathbun, president of the 5 Oaks Property Owners Association, said the circle remains heavily used by trucks and trailers and that county maintenance historically kept it functional. “Is it now considered abandoned county property?” Rathbun asked the court, urging either removal and resurveying to shift maintenance to adjacent owners or a county-funded repaving and continued upkeep.
Rathbun invited commissioners to inspect the site with association members to see the completed roadwork and discuss possible remedies.
