Committee to point procurement and disposal rules to state law, remove dated dollar thresholds

The codification committee recommended removing detailed personal-property disposal language from the ordinance and directing readers to Mass General Laws and state procurement thresholds. Members said state procurement thresholds change frequently and that pointing to MGL (and listing procurement thresholds in Appendix D where appropriate) would avoid repeated ordinance updates.

"The recommendation of the request here is to update where it says 1000 dollars to $10,000," the chair said during discussion of Article 23; members debated whether to hardcode any threshold or simply refer to MGL procurement laws. The committee voted to delete sections 2-127 and 2-128 from the ordinance and to add a cross-reference reading, in effect, "subject to Mass General Laws regarding procurement and thresholds." The motion carried in roll call (3 ayes).

Committee members emphasized that disposal of real property (land or buildings) should remain explicit in ordinance text because different statutory rules and two-thirds legislative thresholds may apply. The committee asked General Code to prepare revised language that points to state law for personal property and to consolidate the fee/threshold details in Appendix D for future updates.
