Sutton planning members, NVDA clarify zoning authority and suggest bylaw review

The Sutton Development Review and Planning Commission representatives told the Select Board that regional planning updates under Act 181 do not automatically override the town’s zoning and town plan, and offered NVDA support if the town wants technical assistance.
Rob Simms and Scott Cunningham said NVDA staff Alison Low and Liam Abbate can attend a meeting to answer questions. Paul Brouha, the NVDA representative, described the agency's advisory role "between the towns and the state" and suggested the town consider revising bylaws and the town plan to address topics such as short-term rentals.
Simms told the board that, under current practice, the town zoning and town plan take precedence and that Act 250 could offer only a partial exemption in certain cases. He also identified Sutton Village — which is supplied by a village water system — as a potential area for targeted changes that might qualify for state funding.
The Select Board did not take formal action at the meeting but directed staff to consider scheduling NVDA attendance to discuss the planning questions further.
