Payson council enacts ordinance to let police trespass disruptive people from public facilities for up to one year

Payson City Council voted unanimously on July 1 to amend Title 6 of the municipal code to add a trespass enforcement and exclusion authority for public facilities.
Staff explained the ordinance formalizes an existing property-owner trespass power and establishes a standardized process for public facilities such as the pool and skate park. The amendment allows police to trespass people from public places for threatening or violent illegal conduct for a period of up to one year, and it creates an appeals process with the police chief able to rescind or modify a trespass notice for mitigating circumstances. "With this amendment, what we're doing is codifying a procedure where police are able to, trespass people from public, places...for a period of up to 1 year," the presenting staff member said.
Councilors discussed constitutional concerns; one councilor said they had worried it might be unconstitutional until meeting with the chief, who explained appeal rights and limits. The council approved the ordinance by roll call.
