Potter County commissioners authorize participation in Kroger opioid settlement

Potter County Commissioners Court voted unanimously on Nov. 25 to authorize the county’s participation in a Kroger settlement tied to the Texas opioid multidistrict litigation and to let county officials sign the required order, resolution and participation/release forms.
Judge Tanner brought the item forward after the court returned from executive session. Commissioner (speaker 4) moved "Move to approve the accept the, Kroger settlement with Potter County authorizing county officials' signature on the order resolution and the Texas release and participation form." The motion was seconded and passed 5–0.
The settlement participation was discussed under executive-session authority for attorney consultation and deliberation on offers of settlement under Texas Government Code §551.071 and related procurement/settlement rules; the judge read the MDL cause number and identified the underlying matter as County of Potter v. Purdue Pharma, pretrial cause number 2018-63587 in Harris County. No additional financial terms were read into the public record during the open-session motion.
