The board authorized legal action July 28 to clear title to an unimproved 0.5-acre parcel in Benton Township that was identified as school property in 1913.
Attorney Munger explained the consolidation of township properties into the Monroe County Community School Corporation means the parcel should be MCCSC property, but adjacent owners had taken possession out of the chain of title. "This particular parcel was identified in 1913 as a school property," Munger said, and the requested resolution would authorize filing a lawsuit to obtain an order confirming MCCSC ownership and clear the title so the district can manage or dispose of the parcel as appropriate.
Trustees asked procedural questions about the resolution and were told a plain motion authorizing counsel to file suit would suffice; the board voted in favor and the motion carried. Counsel said there is nothing on the property and it lies on North Tunnel Road; the action seeks to clarify ownership rather than immediate development.
