Work group: community benefit agreements voluntary but commissioners control county agreements

Presenter (speaker 1) explained the ordinance language and legal limits: "A voluntary CBA shall not be required for approval of a data center app and shall not be used to impose mitigation obligations unrelated to document land use impacts." He said a CBA may address workforce training, emergency‑response support or sustainability commitments, but it is voluntary; however, when an agreement is executed it must be approved by the county commissioners. Several members suggested economic development staff and commissioners should help craft a recommended CBA template to put negotiation parameters on the table.
