Council attorney says fees may have been routed incorrectly to general fund; urges statutory compliance

The council attorney reviewed the county’s filings and told the body she could not find a separately maintained fund for Area Plan Commission permit and equipment fees. She said state statute requires those fees to be collected into a distinct fund and not revert to the general fund, and she urged the county to correct any improper accounting.
She told the council she would provide the specific statute and follow up with Jennifer (county staff) to determine whether the Department of Local Government Finance or State Board of Accounts has a fund number to assign; if not, she recommended the commissioners create a home-rule fund to hold the fees going forward. "It was very clear looking at the statute that we should have one, and this should not be going in the general fund," she said.
