Applicant says Maryland voluntary cleanup enrollment will limit future residential use at 4110 Suit Road

At the Aug. 7 hearing on ZMA 2023-002, Dan Berger, director of development for Open Industrial, described the company's preliminary acceptance into the Maryland Department of the Environment (MDE) Voluntary Cleanup Program for the 4110 Suit Road property.
Berger said the voluntary program bases remediation and closure requirements on the future intended use and that, because Open Industrial anticipates commercial/industrial reuse, MDE will likely require a land-use or deed restriction confining the property to nonresidential use and a groundwater-use restriction. "This acceptance into the program... will require that upon completion... land use or deed restriction be placed on the property to allow for only nonresidential use and also likely will require groundwater use restriction," Berger testified.
Berger emphasized the environmental issues predated Open Industrial's ownership and that remediation is ongoing: soil and groundwater contamination, largely petroleum-type organic compounds, have not been fully remediated. Counsel said the applicant will provide more detailed consultant documentation if requested and will notify adjacent residents in writing when remedial field work is scheduled.
