Fairfax to require noise studies and utility demand statements for high-energy-use facilities

Under HB153/SB94, projects classified as high-energy-use facilities (100 megawatts or more) must submit a noise study of impacts on schools and residences within 500 feet and a statement from the utility identifying anticipated energy demand and source. Fairfax will add submission requirements for rezonings and special exceptions for such facilities (commonly data centers).
Gastrell described HB153/SB94, which defines a high-energy-use facility (HOOPF) as a use requiring 100 megawatts or more and requires additional submission materials for rezonings or special exceptions involving such uses.
"This legislation defines a high energy use facility as a use which requires more than a 100 megawatts of energy or more," Gastrell said, adding that in Fairfax County this category would typically apply to data centers. The bill requires a noise study assessing impacts on schools and residences within 500 feet and a statement from the utility provider describing anticipated energy demands and the anticipated source of that energy. Staff told attendees the required utility statement and site assessments must be included as part of the application package and reviewed at acceptance so staff have time to evaluate materials before hearings.
A participant raised concerns about the practical timing of receiving utility statements and staff confirmed that the materials are intended to be part of the submission package prior to acceptance for review rather than being provided on the eve of a hearing.
