State requires manufactured homes where site-built homes are allowed; Fairfax to amend zoning table

Fairfax County staff said the state bill HB 655/SB 346 requires manufactured homes to be permitted by right in any zoning district that allows a site-built dwelling.
"This bill requires that manufactured homes be allowed in all zoning districts where a site built home is permitted," said Austin Gastrell, principal planner, who said the county will amend its permitted-use table and associated use standards so manufactured homes and site-built homes are treated equally. As drafted, staff will include a requirement that any permitted manufactured home be no more than five years old and obtain a certificate of occupancy to meet the bill's use standards.
The county also discussed HB1463 addressing nonconforming manufactured-home parks: under that legislation, a locality must allow a new manufactured home to be placed on any open lot within a nonconforming park. Gastrell said staff will amend the nonconformity section to permit replacement or placement on open lots within such parks. Staff emphasized these changes reflect state law and are not discretionary policy choices by the county.
