County adopts overnight parking policy, repeals snow-parking ordinance and authorizes municipal towing

Box Elder County commissioners adopted a new policy (Resolution 26-08) prohibiting overnight parking on county property except by permitted pass and authorizing removal/towing of vehicles that violate signage and the policy. County Attorney’s Office staff said the policy is intended to allow buildings and grounds staff to keep lots clear for plowing and maintenance and to provide a clear process for enforcement.

Glenn Thurston, representing the County Attorney’s Office, told commissioners the policy allows the county to issue a pass for contracted users and display it on a vehicle dash; otherwise, vehicles parked overnight may be towed in accordance with state statute and posted signage. He said enforcement had been difficult without formal signage and authority: “By enacting this policy... we will be able to remove those and get the lots plowed.” Commissioners approved Resolution 26-08 unanimously.

At the same meeting, commissioners approved Ordinance 645, repealing Ordinance 542 (the prior snow-parking rule) because staff found it may be unenforceable under state statute; the repeal brings county rules into alignment with state law. Commissioners also approved letters of agency to clarify that Brigham City, Tremont and Garland police departments have authority to tow vehicles from county-owned properties within incorporated areas when appropriate. The letters were approved so municipal officers would not defer towing tasks that fall within their jurisdictional powers.

The actions are recorded as Resolution 26-08 (overnight parking policy), Ordinance 645 (repeal of Ordinance 542) and approved letters of agency for local police towing authority. County staff will determine signage and implement a pass system for contracted users.
