The court debated options and then Esquire Cummings moved to grant the hearing for Aug. 13 at 8:30 a.m.; Esquire Aldridge seconded the motion and roll-call votes were all affirmative.
The notice of opposition seeks an opportunity for the filer to state grounds for appeal of the planning commission's decision. Chandler described three procedural options available to the court — do nothing, refuse a hearing, or hold either a hearing on the record or a de novo hearing — and advised that a hearing on the record was appropriate in this instance. The court directed staff to notify media and interested parties of the scheduled hearing.
The item was raised during the court's legal update; the matter will return to the court's Aug. 13 session at 8:30 a.m. for hearing and any subsequent action required by the court's findings.
