Staff seeks council blessing to make sidewalk and alley waiver processes administrative and extend sidewalk refund window

Planning staff presented a staff‑initiated amendment to the Garland Development Code (GDC) to streamline certain plat‑linked processes and to adjust timing expectations for sidewalk refunds.

Staff explained that state changes made plats administrative and that related processes—such as sidewalk and alley waivers—are now interlinked with plats. The proposed change would make sidewalk and alley waiver decisions administrative (the director of engineering would decide) with planning commission serving as the appeal body, to avoid duplicative plan commission processing and to align regulatory flow.

Staff also proposed increasing the sidewalk refund/design requirement from the current two years to five years and requiring that the sidewalk be designed for construction within the five‑year window (instead of fully constructed). Staff said the longer window is realistic for city project timetables and would allow the city to use payments to build sidewalks rather than refund them when construction timing slips.

Council asked clarifying questions about orphan sidewalks and why waivers exist; staff said waivers prevent short orphaned sidewalks (e.g., a 100‑foot sidewalk with no connection). Council signaled support for staff to research and draft proposed amendments; the council unanimously asked staff to return with the ordinance language for formal consideration.

Next steps: staff will draft GDC amendments and return with proposed ordinance text and analysis.
