Council approves rezoning of parcel owned by Council member Henry; Henry abstains

The New Market Town Council voted May 18 to rezone parcel 104‑A‑15B (about 2.5473 acres) from transitional classification X to Business District B‑1 following annexation into town. The annexation required zoning to be set within six months under the annexation agreement; council members said B‑1 best matched the property’s commercial designation in the agreement.
Town Attorney Ham advised the council that the parcel is owned by Council member Jon Henry and noted the abstention procedure: "per the Town Code 2‑44 states in case of abstention the council member needs to advise the presiding officer of the intention to abstain and the reason therefore." Henry announced he would abstain, and the motion to approve the rezoning, moved by Buz Menhardt and seconded by Scott Wymer, passed on a roll‑call tally showing Menhardt, King, Hannah and Wymer voting aye and Henry abstaining.
The rezoning was presented as the final step after a joint public hearing with the Planning Commission on May 4; no amendments to the rezoning proposal were recorded during the council meeting.
