In its findings the county cited the property’s continuous use as a church and cemetery since the 1870s and the Chisago County Comprehensive Plan’s guidance to protect cultural and historic sites. The Board’s approval is contingent on the Final Plat of Rush Pointe being approved and filed prior to the CUP being filed with the Chisago County Recorder’s Office; the resolution also requires annual certification and authorizes county inspection to ensure continued compliance.
County documents and the Planning Commission record indicate the Nessel Town Board and the Planning Commission recommended approval with no conditions. The resolution lists multiple findings under Zoning Ordinance Section 8.04, C. and spells out conditions including limits on future expansion and requirements for federal, state or county wetland permits if impacts are proposed.
The motion passed unanimously: Commissioners Swenson, Greene, Dunne, Montzka and Dahlberg voted in favor.
