Mayor Johann R. Wallace said the Town has repeatedly spent money remediating hazardous conditions on a set of properties and wants to know whether foreclosure of abatement liens might allow the Town to recover costs. Town Attorney Thomas Benavidez told the Council the process is complicated and will require expenditures; he said the Town has already spent $16,000 on remediation at 217 Pima Street.
Council moved to direct staff to explore possible foreclosure on the Town’s abatement liens for 217 Pima St., 303 Apache St., and 103 Tomahawk; the motion, moved by Johann Wallace and seconded by Christy Hirshberg, passed unanimously. Attorney Benavidez cautioned that the properties may not be worth the cost to foreclose and that the Town should weigh recovery potential against legal and procedural expenses.
Staff will return with an analysis of costs, the foreclosure process, and a recommendation on whether foreclosure is a financially prudent approach.
