Commission recommends Selectboard consider opting Lyndon into Tier 1B for limited Act 250 exemptions

Planning Director Tracy Bodeo briefed the commission on Tier 1B final guidance at the Jan. 14 meeting. She said representatives from the regional planning organization were present to answer questions. Commissioners were shown where Tier 1B designation would apply within town boundaries and were told the designation would allow Act 250 exemptions for up to 50 housing units on parcels of 10 acres or less and would not trigger Town Act 250 review or additional flood regulations.
Commission members expressed no objections and reached consensus there were no negatives to opting in. They agreed that if asked by the Selectboard they would recommend that the town sign a resolution to opt into Tier 1B. The item will be placed on the Selectboard agenda for Feb. 2, 2026 for that board's consideration.
No formal vote was recorded by the Planning Commission on Jan. 14; the commission's role at this stage is advisory to the Selectboard.
