The applicant’s attorney described plans for roughly 280–288 multifamily units; nearby residents testified at length that Baxter Well Road and nearby FM 1461 lack the infrastructure to support the proposed density.
Stephanie Wayenberg, a Baxter Well Road resident, said the road is unsafe and not built to handle high-density traffic: "Baxter Well Road is not capable of supporting a multifamily high density apartment complex... the asphalt that is on it is no thicker than my cell phone," she told commissioners. Multiple residents echoed concerns about school-bus safety, increased heavy-vehicle traffic and loss of the area's rural character. Staff explained these parcels lie in the city's extraterritorial jurisdiction (ETJ), that property-owner notice rules differ for ETJ parcels, and that infrastructure improvements would typically be required as part of annexation and development review. After public comment and commissioner discussion, a motion to deny passed 3–2; staff told the room that a council action will require a super‑majority if the applicant proceeds.
