Commissioners discussed what circumstances should trigger conditional review or allow denial of a short-term rental special-use permit. Ideas raised included access from a private lane and whether a dwelling located within 300 feet of another dwelling should trigger additional scrutiny. Staff noted that measurable standards are easier to enforce and to review through the Board of Zoning Appeals (BZA).
No denial criteria were adopted at the meeting. Chairman Burner specifically directed staff to ask the County Attorney about whether those triggers and potential denial standards would be legally supportable under county authority and requested that staff return with options.
