The board approved a front-yard variance request from Barret Marshall to build a 40' x 70' house 130 feet from the center of 204th Street, a 20-foot deviation from the setback requirement.
Staff noted the applicant sought the variance to align the house with an existing driveway and retain an historic crab apple tree; Kingbrook Rural Water approved the house placement. Marshall said the proposed house would sit about 135 feet from the centerline compared with roughly 87 feet for the current residence. Board members reviewed findings of fact and, after discussion about the unique hardship, approved the variance 7–2.
The board recorded that a failed vote would force the applicant to wait six months to reapply; findings of fact were placed on file at the hearing.
