The Brown County Board of Zoning Appeals approved a rear-setback variance for property at 2660 Lanam Ridge Road in Nashville after the petitioner amended the request to a 15-foot rear setback. Planning Director Kayla Robertson read the staff report; Darrin Kean, the petitioner’s father and the property owner affected, described survey errors and steep slopes that limit alternate siting.
Board members debated the extent of hardship required under the zoning ordinance. Michael Harrison told the board he "would be more receptive to allowing a 20-foot setback rather than a 5-foot setback," and after discussion President John Dillberger said he would approve no less than 15 feet in an effort to change course on a history of informal waivers gradually. Petitioner Galen Kean agreed to amend the petition to seek a 15-foot rear setback, and the board voted to approve the variance as amended.
Board members cited concern about precedent if the ordinance is ignored, but several also said the particular lot conditions and survey errors made denial difficult. The board recorded a unanimous roll-call approval among the four members present.
