The county engineer noted the fog‑seal item is only one component of the overall bid and that even with that higher unit price the apparent low bidder's overall tab was still lower than others. He recommended the court consider that the fog‑seal could be omitted or re‑solicited if the court believed the unit cost was unreasonable, but also cautioned that prices might not decline. "That unit price of $3.75 is almost twice as much as I would have expected it to be... I looked at TxDOT bid prices... and it was a dollar 75," the engineer said. Commissioners discussed the tradeoffs and accepted staff's recommendation to award to CK Newberry LLC; the vote carried 5-0.
Staff said the county could elect not to purchase specific high‑cost line items on the bid tab and proceed with other work at the awarded prices, or reject and resolicit the fog‑seal line separately. The court authorized the judge to execute necessary documents.
