The Cayuga County Legislature on Jan. 29 approved Resolution 04-26, authorizing special counsel to execute a Stipulation of Settlement in Walmart Inc. Business Trust Dept. #US01830 v. Board of Assessment Review (City of Auburn). The parties agreed to no reduction in the 2025 assessment and the 2026 assessment roll will reflect a full market value of $17,333,333 for the parcel at 297 Grant Avenue (Tax Map 109.48-1-3.115).
Ways & Means Chair Elane Daly presented the settlement rationale, stating county counsel and special counsel judged settlement preferable to trial to avoid additional expense and risk. The resolution directs the County Treasurer and Director of Real Property Tax Services to make necessary entries to tax and assessment records after the stipulation is fully executed.
The resolution also cites application of Real Property Tax Law Section 727 to 2027–2029 as part of the settlement's terms. The motion passed on a recorded legislative action (motion by Robert Shea, second Nightengale, all in favor).
