Change order executed for Eastside Estates #3 erosion repair; work awaits Sovereign Lands permit

HDR staff reported that a change order for erosion repairs at Eastside Estates #3 has been executed and Blue Stone Construction will begin work once the Sovereign Lands Permit is issued by the North Dakota Department of Water Resources (NDDWR). The Sovereign Lands Permit application was submitted on May 13, 2026 and public comments closed May 27; the permit is under review.
Karli Frohling (HDR, via Teams) said the U.S. Army Corps of Engineers (USACE) will not require Section 408 or 404 permits for the Eastside Estates #3 repair. A temporary construction easement has been signed with the property owner for culvert and washout repair. The Board approved a motion authorizing HDR to submit a Section 404 permit application if USACE later determines one is necessary for the nearby Saugstad culvert replacement (motion passed 5-0).
